Resumen

What Is the EB-2 Visa?

The EB-2 category provides lawful permanent residence (a green card) to foreign nationals who qualify through advanced academic credentials or exceptional professional ability in science, arts, or business.

USCIS evaluates whether the applicant’s education, experience, and professional record demonstrate a level of expertise significantly above that normally encountered in the field.

The EB-2 category also includes the National Interest Waiver (NIW), which allows qualified professionals to pursue permanent residence when their work benefits the United States — potentially waiving the requirement of a job offer and labor certification.

EB-2 Qualification Paths:
1

Advanced Degree Professional

U.S. master’s or higher, or bachelor’s + 5 years progressive experience.

2

Exceptional Ability Professional

Degree of expertise significantly above the average in the field of science, arts, or business.

3

National Interest Waiver (NIW)

Exceptional ability with work that benefits the United States — waives job offer requirement.

EB-2 National Interest Waiver

What Is the NIW — and Who Qualifies?

The National Interest Waiver (NIW) is a discretionary provision within the EB-2 category that may allow USCIS to waive the job offer and labor certification requirements when the applicant’s work is deemed beneficial to the United States. USCIS evaluates NIW cases under a three-prong framework.

Substantial Merit &
National Importance

The proposed endeavor must have substantial merit and national importance — serving a field or area of U.S. interest.

Well-Positioned to
Advance the Work

The applicant must be well-positioned to advance the proposed endeavor based on their education, skills, and track record.

Beneficial to Waive Requirements

It must be beneficial to the United States to waive the job offer and labor certification requirements for this individual.

EB-2 Petition Process(Step-by-Step)

The EB-2 visa cannot be self-petitioned. A petition must be filed by:

1

Eligibility Assessment

Review education, experience, and career trajectory. This is where we evaluate your profile against USCIS standards and determine whether EB-2 exceptional ability, advanced degree, or NIW is the strongest path.

2

Case Strategy & Positioning

Build a clear narrative connecting your professional record to USCIS standards. A well-prepared EB-2 petition tells a cohesive, credible story that aligns achievements with adjudicator expectations.

3

Evidence Collection & Organization

Compile and prioritize documentation aligned with USCIS criteria — academic records, employment letters, licenses, compensation evidence, and professional recognition.

4

Presentación del formulario I-140

Submit the EB-2 immigrant petition to USCIS. Premium Processing may be available depending on current USCIS rules.

5

Revisión del USCIS

USCIS may approve the petition, issue a Request for Evidence (RFE), or deny the case. Weak positioning or unclear narratives can lead to RFEs even for strong candidates.

6

Adjustment of Status or
Consular Processing

Complete the final step toward permanent residence. Processing times and procedures depend on category and applicant location.

EB-2 Green Card FAQs

Answers from the immigration attorneys at Gondim Law Corp, Los Angeles. Every case is different; this is general information, not legal advice. Schedule a consultation to discuss your situation.

Who qualifies for an EB-2 green card?

The EB-2 category is for professionals holding an advanced degree (a U.S. master's or doctorate, or a bachelor's degree plus five years of progressive experience in the specialty) and for individuals with exceptional ability in the sciences, arts, or business. Exceptional ability means a degree of expertise significantly above that ordinarily encountered in your field, proven with documentary evidence such as degrees, licenses, at least ten years of full-time experience, salary evidence, memberships, or recognition from peers and industry bodies. Most EB-2 cases require a job offer from a U.S. employer and an approved PERM labor certification. The exception is the National Interest Waiver, which lets a qualified person self-petition. Our Los Angeles immigration attorneys review your credentials before filing to identify which route gives you the strongest case.

What is an EB-2 National Interest Waiver (NIW)?

A National Interest Waiver allows an EB-2 applicant to skip both the job offer and the PERM labor certification and petition for themselves. USCIS evaluates NIW requests under the Matter of Dhanasar framework, which asks three questions: does your proposed endeavor have substantial merit and national importance; are you well positioned to advance it; and would it, on balance, benefit the United States to waive the job offer and labor certification requirements. Evidence typically includes a detailed endeavor plan, publications, citations, patents, letters from independent experts, business results, funding, media coverage, and proof of demand for your work. The NIW is popular with researchers, physicians, engineers, and entrepreneurs. It is a discretionary standard, so how the petition is argued matters as much as the underlying credentials.

Do I need a job offer or PERM for EB-2?

For a standard EB-2 petition, yes. Your U.S. employer must first obtain an approved PERM labor certification from the Department of Labor, which requires a prevailing wage determination and a documented recruitment effort showing no qualified U.S. worker is available for the role. The employer then files Form I-140 on your behalf. If you qualify for a National Interest Waiver, both the job offer and PERM are waived and you file the I-140 yourself. Choosing between the two paths depends on your evidence, your employer's willingness to sponsor, and how quickly you need to move. We assess both options at the outset so you are not locked into a slower route than necessary.

How long does an EB-2 green card take?

Timelines have two separate components. The first is USCIS processing of the I-140 petition, which varies by service center and can be shortened with premium processing where available. The second, and usually the larger factor, is visa availability: EB-2 is subject to annual per-country limits, so applicants chargeable to heavily oversubscribed countries can wait years for a priority date to become current, while applicants from most other countries move considerably faster. Because the Department of State updates the Visa Bulletin monthly, we check your specific chargeability and priority date rather than quoting an average. Contact our office and we will map the realistic timeline for your country and category before you file.

Can I include my spouse and children?

Yes. Your spouse and unmarried children under 21 can be included as derivative beneficiaries and receive green cards based on your approved EB-2 petition. If they are in the United States in valid status, they generally file Form I-485 to adjust status alongside or after you; if they are abroad, they go through consular processing at a U.S. embassy or consulate. Children approaching their 21st birthday need careful attention, because aging out can cost them eligibility. The Child Status Protection Act may preserve their place depending on filing dates and visa availability, so timing is critical. We track dependents' ages and status expiration dates as part of every employment-based case we handle.

Should I file EB-2 NIW or EB-1?

Both allow self-petitioning without an employer, but the standards differ. EB-1A requires sustained national or international acclaim as a person of extraordinary ability, evidenced through a defined list of criteria such as major awards, memberships requiring outstanding achievement, published material about you, judging the work of others, original contributions of major significance, and authorship of scholarly articles. EB-2 NIW asks instead whether your specific proposed endeavor is nationally important and whether you are well positioned to advance it, which is often a more attainable showing for skilled professionals and entrepreneurs. EB-1 also usually has better visa availability. Many clients qualify for both, and filing strategy depends on evidence strength and country of chargeability. We advise on this in the initial consultation.
